Online & Cellar Shop Terms & Conditions

This legal notice applies to all purchases made by you through the website under the domain name CHILTERNVALLEY .CO.UK (the “website”). By offering to purchase products through the website you are entering into an agreement with Chiltern Valley at Old Luxters Vineyard, Winery & Brewery, on the terms and conditions set out below. These terms and conditions of sale are additional to and not a substitute for the general terms and conditions of use of the website which can be found www.chilternvalley.co.uk/help/terms-and-conditions.htm

1. Purchase of products from Chiltern Valley, On line.

The descriptions on the website/in the cellar shop, of the products supplied by Chiltern Valley are necessarily subjective but are intended to give a general description of the products to the best of our knowledge. No such description can ever replace the information gained during a tasting at our cellar shop to which you are welcome 7 days a week.
Chiltern Valley warrants that it has the right to supply all products offered by it on the website.
When the stock of any particular vintage runs out, Chiltern Valley reserve the right to substitute another vintage of the same wine.
In all other respects and to the maximum extent permissible, Chiltern Valley make no other warranties or promises about the products, and any implied warranties are excluded.

1 a) Availability, prices and information on products

All products are offered for sale by Chiltern Valley subject to availability. The price of the products shall be the price listed in UK pounds sterling on the website on the date of your order (inclusive of VAT & Excise Duty, but exclusive of delivery charges which are payable by you). All prices displayed on the website are and must be paid in full, including delivery charges, except where discounts are offered as detailed on the website. Promotional codes and/or discount offers cannot be used in conjunction with any other offer.

1 b) Ordering

By placing an order which includes alcohol you confirm that you are at least 18 years old.
When you click on the “Finish Button” on the “Checkout” page Chiltern Valley will treat the order as an offer by you to purchase the products subject to these terms and conditions of sale. You are responsible for ensuring the accuracy of your order and any specific delivery instructions (e.g. “behind the garage – with the neighbour or – in the garden shed etc.”) and if Chiltern Valley accepts your offer they shall supply you, subject to availability, with the quantity and specification of products set out in your order.
If Chiltern Valley accepts your offer they shall confirm each order online via the internet or by email and such confirmation shall be Chiltern Valley's acceptance of the contract between the parties.

1 c) Delivery & retention of title

All products will be delivered to the address that you indicate on the “Checkout” page and so far as possible in compliance with any specific delivery instructions, referred to above.
Whilst the risk of damage to or loss of the products shall pass to you the purchaser upon leaving the premises of Chiltern Valley, title in the goods shall not pass until the whole purchase price including the cost of transport, has been paid in full.
Any times quoted for delivery are approximate only and time shall not be of the essence. Chiltern Valley shall not be liable for any delay in delivery of the products howsoever caused.
Chiltern Valley shall confirm each order in writing by sending you a printout of the order along with your products.

1d) Returns

If any of our products fall below the high standards you expect please return them within 28 days and we will refund or exchange the item. Please have your invoice with you to do this. If you change your mind within 28 days, we are happy to refund or exchange the product provided it is returned, as sold, with all the original packaging, tags, labels and accessories. Please have your order confirmation email with you to do this. We will not refund the costs of return postage to us unless the products are faulty.

You may not cancel your order if:-

(a) It is for products that are personalised, e.g. bearing specially personalised labels.
(b) Products that cannot be returned or are liable to deteriorate or expire rapidly.

2. Personal data

When you make a purchase from this website, the personal information collected enables us to process and deliver your order. By registering your details on our website, you consent to the recording, holding and using the personal data we collect about you. Nothing contained in this clause or elsewhere allows us to retain credit card details which we do not retain. We are committed to the Data protection legislation and completely dedicated to the privacy of our customers information.

3. Limitation of liability

Chiltern Valley's liability to you is limited to the price of the products purchased and the delivery cost involved and in particular is not liable to you for any indirect or consequential loss (including without limitation financial loss such as loss of profit, or otherwise) that you may incur as a consequence of its failure to comply with these terms and conditions of sale.

4. Changes to the terms and conditions of sale

Our terms and conditions of sale may be changed. Please review them regularly. If you continue to use the website after a change has been made you are deemed to have accepted it.

5. Law and jurisdiction

These terms and conditions of sale shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising in relation to the website shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If any of these terms or conditions of sale should be determined to be illegal, invalid or otherwise unenforceable, it shall be deemed deleted and the remaining terms and conditions shall survive and continue to be binding and enforceable.

Tour & Cellar Shop Terms & Conditions

Chiltern Valley Winery & Brewery reserve the right to cancel tours due to safety reasons such as snow or ice or if guest numbers are too low (4 or less). We will endeavour to give as much notice as possible in this event and most probably will email the customer directly to inform of this.

Promotional codes and/or discount offers on the market (such as The Henley Card members club) cannot be used in conjunction with any other offers or discounts.

Voucher Terms & Conditions

Vouchers cannot be refunded or exchanged for cash or other denominated vouchers. If an intended purchase is for a higher amount than the face value of the voucher(s), the difference can be made up with cash. If a purchase is for a lower amount, NO change can be given.

Vouchers cannot be replaced if lost, stolen or damaged.

Each voucher will have it's own unique expiry date. Ideally you need to attend one of our tour & tastings BEFORE the voucher expires, if you do choose to come after the expiry date of your voucher a £15 extension fee will be applied.

Old Luxters Farmhouse B & B

Once a booking is made no refunds will be given. Should you need to amend or move your reservation please contact us at least 72 hours prior to the day of your arrival – if you cancel after this time you will incur a cancellation charge for the full amount.

Old Luxters Vineyard Cookery and Wine Pairing School

General terms and conditions for all courses provided by Sarah at Ltd in conjunction with Chiltern Valley Vineyard Winery & Brewery LLP.

Sarah At Ltd, run the Cookery School and Knife Skills element of the courses advertised on this site. Chiltern Valley Vineyard Winery & Brewery LLP run and provide the various wine tours, tastings and B&B accommodation, if required, (hereinafter collectively referred to as ‘the providers’)

Together they aim to provide guests with practical cookery tuition, demonstrations, wine tour and tasting elements and knife skill activities of the highest quality throughout the duration of the course.
Course fees must be prepaid in full, no less than 4 weeks prior to beginning of each course. The providers will do their best to accommodate applicants seeking to book later than the 4 week deadline but cannot guarantee a place in those circumstances.
If a guest wishes to cancel a course, more than 4 weeks prior to the start of the course, the providers will make a full refund less £50 which will be retained to cover administration costs. If the guest re schedule their course booking, then this administration charge will not be made.

If a guest wishes to cancel within 4 weeks from the start of the course, fees may only be refunded in the event that the course is full or when a replacement student is found before that course starts.

Course fees will not be refunded at all if all or part of the course is unattended.

Any prepaid booking fee will be returned if the providers are unable to offer a place on the guests preferred choice.
The providers reserve the right, in circumstances outside their complete control, to alter the timing or content of any course or part thereof or to substitute any teacher or instructor or to cancel a course at any time.
If a guest is considered by the school to be unsuitable for any reason, the guest may be required to leave, either immediately or within a specified time.
The providers shall be under no liability whatsoever, for any loss, injury or damage to guests or their property, whether in respect of any neglect, act or omission by the providers, their agents or employees.

2018 Newsletter Competition Terms & Conditions

Entry requirements:

Entrants must be 18 years or older.

Entrants may be asked to provide suitable Identification for proof of age at any point.

Entrants must provide a valid email address.

Entries to the competition will close on the 16th December 2018.

This competition is for UK residents only.

Upon entry to this competition the entrant gives consent to be contacted Via email by Chiltern Valley winery and Brewery with our Newsletter

All data provided by entrants will be held securely in accordance with: The Data Protection Act 2018 and we will NOT share any of your details with any third parties.

Prizes:

The prize draw will take place on December 20th 2018.

All prize will be in voucher form for the specified prize apart from 3rd Prize (a bottle of English Sparkling wine) which will be sent to the winner’s address after the prize draw has taken place, delivery is free of charge as well.

Prizes can only be used for there intended use and cannot be exchanged for goods or cash.

1st prize:

One-night stay in Chiltern Valley Winery and Brewery B&B (for two Adults) and a tour and tasting for two. This prize will be valid for 1 year from the date of issue and must be booked and used within its validity period. The prize has a total combined value up to £145 and can only be redeemed for its intended use. The prize will be issued in two vouchers: The first Voucher worth £115 can be redeemed with a one nights stay in the Chiltern Valley B&B: Any rooms that have a higher room rate than £115 will require an additional cost to the prize winner to cover the total room rate. The second voucher has a total worth of £30 for a Tour and Tasting for two adults and can only be used for its intended purpose. 2nd Prize:

A tour and Tasting for two including a special gift. This will be a voucher for Two adults to attend a Tour and Tasting at Chiltern Valley Winery and Brewery with the winners choice of a still bottle of wine from our selection of wines available on the day of visit. The maximum cost of the wine chosen cannot exceed £13.95. If the wine selected by the winner has a value of less than £13.95 no change or compensation will be given for the remaining value of up to £13.95. 3rd Prize:

A Bottle of Chiltern Valley English Sparkling wine. This prize will be sent on or after the 20th December for the 3rd randomly selected entrant. The third prize recipient will be notified via email upon completion of the prize draw. The prize winner will be asked to provide their address details for the winning prize to be sent. The Prize will be sent within 14 days of receipt of the winner’s details. This Prize cannot be exchanged or refunded for any other Chiltern Valley or Old Luxters product. The Prize cannot be exchanged for the equivalent cash value.
